CLARITY Act Faces Growing Doubts Ahead of Sept. 15 Senate Vote

The U.S. CLARITY Act is facing renewed uncertainty just days before a key Senate vote, with former federal prosecutor Renato Mariotti claiming that lawmakers and congressional staff in Washington believe the legislation has effectively reached the end of the road.

Mariotti's comments come as the Senate prepares to consider a cloture motion on the motion to proceed to H.R. 3633, the Digital Asset Market CLARITY Act, on Sept. 15. The Senate's official schedule confirms that the cloture motion will ripen at 2:15 p.m. that day.

The situation leaves the crypto market structure bill caught between continued support from Republican lawmakers and increasingly low expectations among some observers and prediction-market traders.

Mariotti Says Washington Has Given Up on CLARITY

Mariotti, a former federal prosecutor, said he spent the week in Washington speaking with members of Congress and their staff. In a post shared through CoinDesk's X account, he said the message he heard was unequivocal:

“CLARITY is dead. Congress is entering a post-CLARITY era.”

The assessment represents one of the more pessimistic public views of the legislation's prospects. It also comes after months of negotiations over provisions affecting digital asset market structure, stablecoins and decentralized finance.

The bill itself remains active. The Senate has already filed cloture on the motion to proceed to H.R. 3633, meaning Mariotti's assessment reflects his reported conversations and not a formal congressional decision to terminate the legislation. The Senate's official cloture records continue to list the CLARITY Act motion to proceed.

Lummis Warns Failure Could Push Crypto Legislation to 2030

Sen. Cynthia Lummis has offered a sharply different assessment of what is at stake.

The Wyoming Republican has repeatedly argued that failing to pass market structure legislation during the current Congress could leave the next meaningful opportunity several years away. In the source report, Lummis said that if CLARITY fails during this Congress, the next real opportunity could come in 2030.

Her previous public statements show why she continues to push for completion. In July, Lummis released updated CLARITY Act text and described the coming weeks as potentially the last realistic opportunity in years to establish a U.S. digital asset framework.

The legislation has already advanced significantly. The Senate Banking Committee passed the bill by a 15-9 bipartisan vote in May, according to Lummis' office.

The Senate Banking Committee has also described the legislation as an effort to establish clearer rules for digital assets and define responsibilities between financial regulators.

The Sept. 15 Vote Would Not Pass the Bill

One important distinction is that the upcoming vote is not a final vote on the CLARITY Act itself.

The Sept. 15 proceeding concerns cloture on the motion to proceed. Under the Senate's current schedule, that motion is set to ripen at 2:15 p.m. on Sept. 15.

Cloture generally requires 60 votes in the Senate. Republicans hold 53 seats, meaning seven Democrats would need to join Republicans if all GOP senators supported the motion.

If cloture succeeds, senators can move into consideration and debate of the legislation. That would not automatically make CLARITY law. Additional negotiations, amendments and votes would still be required before the measure could advance through Congress.

Three Major Issues Still Divide Lawmakers

The negotiations remain focused on several unresolved policy questions.

One dispute involves ethics requirements for government officials who hold or interact with crypto assets. Another concerns stablecoin rewards, with banking interests arguing that certain reward structures could create competition with traditional deposits.

A third major issue involves protections and regulatory treatment for decentralized finance developers. These questions have become central to negotiations as lawmakers attempt to determine how broad the legislation's regulatory framework should be.

The House and Senate also face a tight legislative calendar. According to the source report, House leaders reduced the number of September voting days, while the House is scheduled to leave Washington on Sept. 17 and return after the Nov. 3 midterm elections.

Prediction Markets Reflect Low Confidence

Market-based forecasts have also turned significantly more pessimistic.

According to the figures cited in the source report, Polymarket's contract on whether the CLARITY Act becomes law in 2026 had traded between 13% and 18% over the previous week, down sharply from 82% in February. The contract had accumulated more than $11.5 million in trading volume.

Kalshi's market asking whether more than 58 senators would vote yes was cited at 19%. Capital Alpha Partners analyst Ian Katz reportedly lowered his probability estimate for enactment from roughly 40% to 25%, while Galaxy Research placed the probability at 10%.

These figures represent market expectations rather than guarantees. Prediction-market probabilities can change quickly as negotiations, political statements and congressional scheduling developments emerge.

The Vote Is Still Scheduled

Despite the increasingly negative commentary, there is no indication in the official Senate schedule that the Sept. 15 proceeding has been canceled.

The Senate's Daily Press schedule confirms that the H.R. 3633 CLARITY Act cloture motion is scheduled to ripen on Sept. 15. The Senate's cloture database likewise lists the motion to proceed to H.R. 3633, filed on Aug. 8.

That means the immediate question is not whether the Senate will have an opportunity to act, but whether supporters can secure enough votes to advance the legislation.

What Happens If CLARITY Fails?

A failed cloture vote would prevent the Senate from moving forward with the current motion to proceed. It would also reinforce the argument from critics such as Mariotti that the legislation has run out of political momentum.

A successful vote would have the opposite effect, allowing the Senate to begin considering the bill while leaving the most difficult policy negotiations unresolved.

The stakes are therefore larger than the Sept. 15 vote alone. The CLARITY Act is designed to establish a federal framework for digital asset markets, including clearer roles for the SEC and CFTC. The underlying House legislation describes provisions covering digital commodities, regulatory jurisdiction, exchanges, brokers and certain blockchain developers.

For the crypto industry, the outcome could determine whether the United States moves closer to a comprehensive market-structure framework during the current Congress or whether the effort enters another prolonged period of legislative uncertainty.
